Luxembourg parental leave, cross-border workers included

Paid on your salary rather than at a flat rate, and open to both parents. One of Europe's more generous schemes.

Who is entitled

Luxembourg parental leave attaches to the employment contract, not to residence: a cross-border employee in Luxembourg is entitled on the same terms as a resident. You must have been affiliated to Luxembourg social security for a minimum continuous period before the birth, still be in post when you apply, and raise the child at home. Each parent has their own entitlement, which cannot be transferred to the other.

The options

The scheme comes in several formats: full-time leave over a few months, part-time leave spread across a longer period, or splitting into shorter blocks over several years. The split options depend on employer agreement, whereas full-time leave can be taken as of right. The first period must follow maternity or adoption leave for one of the parents.

The payment, and what sets it apart

Unlike most neighbouring schemes, the Luxembourg parental leave payment is calculated as income replacement, between a floor and a ceiling, rather than paid at a flat rate. On a Luxembourg salary, the gap against a flat-rate French, Belgian or German benefit is considerable. It is worth building into the calculation when both parents work on opposite sides of the border: leave taken by the parent employed in Luxembourg often costs the household far less.

What to plan for

The claim goes to the CAE within strict deadlines before the intended start, and filing late loses the period. Notify the employer in writing in the prescribed form. Finally, check how it meshes with benefits in your country of residence: non-overlap rules apply, and drawing an equivalent benefit elsewhere can reduce or suspend the Luxembourg entitlement.
