Going self-employed in Luxembourg

Business permit, social affiliation, VAT: the route for a self-employed worker, and what it changes for a cross-border one.

The business permit comes first

Most commercial, craft and professional activities require a business permit issued by the competent ministry, granted to a person — the manager — on grounds of good repute and, depending on the trade, professional qualification. Regulated crafts require a master craftsman's certificate or a recognised equivalent. This is the step everything else depends on, company registration included, and the one that takes longest when the qualification comes from another country.

Social affiliation is not optional

A self-employed worker affiliates with the joint social-security centre and contributes on professional income, with a minimum base that applies even when income is low — the classic first-year surprise. Health cover and pension are those of the Luxembourg system. For someone self-employed in several countries, only one state's legislation applies, determined by European coordination rules: have it established rather than assumed.

VAT, accounts, administrative rhythm

Above a turnover threshold, VAT registration becomes compulsory, with returns whose frequency depends on volume; below it, the exemption scheme avoids the machinery but bars deduction. An accountant is not required for every legal form, but is in practice as soon as you invoice abroad, which is the norm in a country this size. Budget that fixed cost from the first projection.

Self-employed across the border: where the seat is

Invoicing Luxembourg clients from a French, Belgian or German home is not the same as setting up a structure in Luxembourg: the place of establishment decides the applicable social law, the country where profits are taxed and the VAT regime. A convenience address does not hold: the authorities look at where the work is actually done. The share of self-employed among working residents, published per commune on this site, shows sharp differences between the rural north and the industrial south.

What to do

  • Check whether the intended activity is regulated and which qualification it requires.
  • Have a foreign qualification recognised before filing the permit application.
  • Budget the minimum social contribution from the first projection, low income or not.
  • Settle the question of the seat early: invoicing from home is not establishing in Luxembourg.
  • Budget the fixed cost of an accountant as soon as you invoice outside the country.

Common questions

Can you combine a salary with self-employment?

Yes, subject to the employment contract and the employer's agreement where required. Social affiliation is then calculated on total income, and the side activity still needs a business permit if it falls into a trade that requires one.

Do you need a company, or is a sole trader enough?

A sole trader is simpler and cheaper to open, but does not separate personal assets. A company protects more, costs more in formality and accounting, and quickly makes sense once there are investments, employees or a partner.

Can a cross-border worker invoice Luxembourg clients from home?

Yes, but they are then self-employed in their country of residence, with its social law and its tax — which is not the same as establishing in Luxembourg. A convenience address changes nothing: the authorities look at where the work is actually performed.
